If you have been left of a Will, if the terms are unfair, or you haven’t been adequately provided for, you may be entitled to make a claim for further provision.
Eligible applicants include:
Spouses - married, defacto and in some cases ex-spouses
Children - biological, adopted and in some cases stepchildren
Dependants - financially dependant members of the household
STRICT TIME LIMITS APPLY
NSW: 12 months from the date of death to file your application in Court
QLD:
6 months from the date of death to give notice
9 months from the date of death to file your application in Court

A superannuation death benefit claim is a request to pay out a deceased person's super balance and life insurance to an applicant.
Eligible applicants must be dependants:
Spouses
Children
Financial dependants
In some cases, there may be a binding death nomination which dictates who the benefit must be paid to.

If you have concerns about the circumstances of the making of the last will or the deceased lack capacity at the time of making the Will, you may be entitled to lodge a probate caveat to challenge the validity of the Will.
The Executor or Administrator of the Estate must then prove the validity of the Will. If they are unsuccessful in proving the validity of the Will, the prior Will will be valid. If there is no prior Will, then the estate may be administered pursuant to the rules of intestacy.

Where an Executor or Administrator has failed to administer the estate in a timely manner or pursuant to the terms of the Will, you may apply to the Court to remove them.
We can also assist investigating allegations of misappropriation of Estate assets and proceeds, and take recovery action if necessary.
